I've been meaning to mention this but hadn't got around to it. The other day, Instapundit offered:Meanwhile, Eric Muller thinks it was a mistake to name prosecutor Mike Chertoff as head of Homeland Security, even though he knows and likes Chertoff: "You can't cross-examine a hurricane." Can you prosecute a suicide bomber?
